Florida Judge Orders Fundsz Promoters to Pay $31 Million in Fraud Case

A federal judge has ordered two Fundsz board members to pay over $30 million following a CFTC lawsuit involving a fraudulent crypto and precious metals scheme.

A federal judge in Florida has issued a default judgment against Brian Early and Alisha Ann Kingrey, two promoters of the Fundsz platform. The court ordered the pair to pay approximately $31.48 million after finding they participated in a scheme that defrauded more than 9,000 investors.

The total judgment is split into $15.73 million in restitution for victims and a $15.75 million civil monetary penalty. In addition to the financial penalties, the court imposed permanent injunctions against Early and Kingrey, banning them from trading and registering with the Commodity Futures Trading Commission.

The CFTC alleged that Fundsz promised investors returns of more than 3% per week through a proprietary algorithm used to trade digital assets and precious metals. According to the agency, this algorithm did not exist. Early and Kingrey, who served as board members and moderated the platform's Telegram group, were accused of misrepresenting profits, risks, and withdrawal terms.

The civil action was originally filed by the CFTC on July 31, 2023, and also named Fundsz founder Rene Larralde. Larralde died in 2023, and his estate is currently undergoing asset recovery efforts. To date, approximately $4 million has been recovered, leaving a significant gap between the recovered funds and the total judgment amount.

The case highlights the risks associated with platforms promising high, consistent returns. While the court has issued the judgment, the ability to collect the full amount remains an open question, as enforcement depends on the discovery of assets. Investors are now looking to the ongoing estate recovery process to see if further funds can be returned to victims.
