Hester Peirce Departs SEC After Years of Crypto Advocacy

SEC commissioner Hester Peirce, widely known as Crypto Mom, has officially left the agency, leaving the commission with two remaining members as the industry watches for future regulatory developments.

Hester Peirce, the SEC commissioner frequently referred to as Crypto Mom, officially stepped down from her role on October 2, 2026. Her departure concludes a tenure that began in January 2018, spanning both the Trump and Biden administrations.

Peirce announced her resignation on X on September 25, 2026, with her formal letter dated September 21. Although her term technically expired in June 2025, she remained in a holdover capacity for over a year to continue influencing agency rulemaking and voting.

Following her exit, the SEC is now operating with only two commissioners, Chairman Paul Atkins and Commissioner Mark Uyeda. Both are Republican appointees, and no successor has been named to fill the vacancy left by Peirce.

During her time at the agency, Peirce led the SEC Crypto Task Force, which focused on token classification and staking guidance. Her work involved addressing whether locking up tokens for rewards triggers securities law and determining which assets qualify as securities.

Her legacy at the agency also includes the implementation of a five-year innovation exemption that permits US stocks to trade on-chain via automated market makers. Additionally, the GENIUS Act, which concerns stablecoin legislation, was enacted in 2025 during her time as a commissioner.

Peirce was known for her frequent dissents against the agency's approach to enforcement, consistently advocating for clear regulatory rules rather than regulation through litigation. She previously served on the SEC staff from 2000 to 2008 before returning as a commissioner.

Looking ahead, the industry is focused on who will be nominated for the open seat and how quickly that process might move. Market participants are also monitoring whether the remaining commissioners will continue to advance the guidance established by the Crypto Task Force and how the innovation exemption functions in practice.

Peirce is scheduled to transition to academia in November 2026, where she will serve as an associate professor at the Regent University School of Law.
