SEC and CFTC Face Leadership Vacuum as Hester Peirce Departs

The SEC will operate with only two commissioners following the departure of Hester Peirce, leaving seven total vacancies across the SEC and CFTC and creating uncertainty for crypto regulation.

Hester Peirce, widely known in the digital asset industry as Crypto Mom, is set to leave the SEC on October 2. Her exit leaves the agency with only two active commissioners, Chairman Paul Atkins and Commissioner Mark Uyeda, both of whom are Republicans.

The departure leaves a total of seven empty seats across the SEC and the CFTC. This reduced capacity at the top financial regulators comes as the agencies oversee a $3 trillion crypto market.

The SEC is designed to function with five commissioners to maintain a diversity of perspectives. With only two members remaining, the agency faces a potential quorum issue if a single recusal occurs on any matter. Peirce had been serving in a holdover capacity since her term expired on June 5, 2025, and no successors have been nominated for her seat or other vacancies.

Appointed in 2018, Peirce was a consistent advocate for clearer regulatory frameworks for digital assets. In early 2025, she led the SEC’s Crypto Task Force, which aimed to improve communication between the agency and the industry. Under her leadership, the SEC released staff guidance regarding tokens, staking, and decentralized finance protocols.

Peirce is scheduled to join Regent University School of Law as an associate professor in November 2026. Her departure leaves the SEC in a position where major rulemakings and policy shifts may be difficult to execute due to the limited number of commissioners.

The current regulatory environment remains in a holding pattern as firms wait for formal rules on token classification, exchange registration, and custody standards. While staff-level guidance has provided some clarity, it lacks the legal weight of full commission action.

The lack of a full bench at the SEC and CFTC may complicate future interagency coordination, particularly as Congress considers comprehensive digital asset legislation. The White House and Senate will eventually need to fill the seven vacant seats to restore the agencies to their standard operating capacity.
